There are many ways individuals can enjoy settling into new condominiums. However, dealing with a noise complaint probably isn’t one of them.
More residents may be using outdoor terraces, BBQ areas, sporting grounds, or generally having more people over to visit as the weather gets warmer. It’s important to know what to do if neighbours are making excessive noise, and interrupting the enjoyment of your new home.
What Is A Noise Issue?
According to the Condo Authority of Ontario, a noise issue is usually one of two situations – either someone, or something, on the property is making unwanted noise. If it’s someone, it’s usually an instance of loud music, a party, pets or children. If it’s something, it could be a design or structural element, like the elevators or lack of adequate sound proofing.
Know The Rules of Condominiums
To resolve noise issues, consult your condo’s by-laws and rules. It’s common for condominiums to limit certain activities or noise levels during certain parts of the day. The reasoning is that one neighbour’s actions shouldn’t prevent another neighbour from enjoying the property.
What Are My Options If I Have A Noise Complaint?
Keep a log of the dates and times the noises occur. Once you collect your data, let your condo board know that you have a complaint. Afterwards, the condo management team should investigate the source of the noise. If it’s a physical part of the building, they should order repairs. If it’s a person, the condo management team should contact them on your behalf.
If these strategies don’t fix the problem, you can follow up with the condo board in writing. Afterwards, there are legal actions you can take to try and resolve the issue.
The purchase of a new residence should be a smooth transaction from start to finish. If you have questions about what you can or cannot do on the premises, contact a real estate lawyer familiar with condo regulations and by-laws.
